Crime NO.761 of 2024 Respondent(s) PRAYER To modify the condition imposed against the petitioner with respect to the condition that the petitioner is directed to deposit a sum of Rs.10,00,000 (Rupees Ten Lakhs Only) to the credit of Crime No.761 of 2024 and the defacto complainant is permitted to withdraw the same upon filing a proper petition imposed under Para No.11(b) and Para No.13 of the order dated 21.07.2025 in Crl.O.P.32418 of 2024.

ORDER

The petitioner herein /A1 in a case where the defacto complainant alleged that this petitioner along with 8 others had trespassed into the shop and damaged the property worth Rs.20,00,000/- and also stolen a sum of Rs.45,000/-.

This Court, considering the nature of the complaint, granted anticipatory bail to the petitioner on condition that the petitioner shall deposit a sum of Rs.10,00,000/- to the credit of crime number besides other conditions. 3.Now, the petitioner is before this Court seeking modification of the above said condition. The learned counsel for the petitioner submits that this Court, while granting anticipatory bail, had directed the petitioner to deposit a sum of Rs.10,00,000/- with liberty to the defacto complainant to withdraw the same. Hence, he is aggrieved by permitting the defacto complainant to withdraw the same.

4. This Court finds force in the submissions made by the learned counsel for the petitioner. Accordingly, the condition is modified to the effect that the petitioner shall deposit a sum of Rs.10,00,000/- ( rupees ten lakhs only) to the credit of Crime No.716 of 2024 on or before 02.09.2025 and the said amount shall be invested in a nationalised bank. The said amount has to be returned after disposal of the case. If the allegation regarding the destruction of property is proved, the said amount shall be utilised to compensate the persons who have suffered loss.

5. With this modification, the criminal miscellaneous petition stands allowed. The petitioner is directed to deposit the amount on or before 02.09.2025, failing which, the anticipatory bail granted shall stand cancelled. 19-08-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes nr
