PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a writ of Mandamus, directing the respondents to issue a No Objection Certificate to the petitioner to run a SPA i.e. cross relation massage in the name and style of "AYUSH AYURUR VEDA WELLNESS SPA" at Door No.192, 3rd Street, Gandhipuram, Coimbatore by passing order on the petitioner's representation dated 12.09.2023. ORDER

The Writ Petition has been filed for a direction to the respondent to issue NOC to the petitioner to run a SPA under the name and style of "AYUSH AYURUR VEDA WELLNESS SPA" at Door No.192, 3rd Street, Gandhipuram, Coimbatore on the representation dated 12.09.2023.

2. The learned Government Advocate submits that on receipt of the representation from the petitioner, letter has been sent to the petitioner on 15.09.2023 seeking clarification on certain documents for further action on the request made to give NOC. The following documents were not annexed along with request sought by the petitioner:- "1.Application and Court fee stamp worth Rs.2/- should be affixed on the top right hand side on the application form.

2. Valid no-objection certificate issued by the fire and rescue department.

3.Property tax and business tax (professional tax or Trade license fee receipt for the current year (i.e. 2023-24) Page No.2/4

4.If the owner of the place of business is another person, the lease deed executed by the owner.

5.Valid building stability certificate A, B,C obtained from a Government recognized Engineer.

6.Photo copy of the camera mount.

7.Rs.25/- stamped cover with self-stamped address.

8. Building blue print and topo sketch."

3. If the petitioner furnished all the details and satisfies the requirement of the letter, the request of the petitioner may be considered and the respondent shall pass orders in accordance with law.
