This Civil Miscellaneous Petition has been filed to condone the delay of 433 days in filing the above appeal.

2. Heard the learned counsel for the petitioner.

3. Despite the receipt of notice, none represents the 1st respondent.

4. The petitioner would aver that, on account of the accident that took place on 16.11.2020, she sustained injuries nad has been undergoing continuous treatment. Due to her medical condition, she was unable to contact her counsel immediately. She would further aver that, owing to financial constraints, a delay of 433 days has occurred in preferring the Civil Miscellaneous Appeal.

5. Accepting the averments made by the petitioner in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 433days shall stand waived.
