On the complaint given by one Jayanthi, who is the daughter-in-law of the petitioners, the respondent police had called the petitioners to participate in the enquiry on 23.09.2023 and again on 26.09.2023, alleging that, the police is frequently calling them and harassing under the guise of enquiry, the present Criminal Original Petition is filed not to harass. 2.
The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the complaint was received on 12.09.2023 from Jayanthi alleging that, the petitioners are withholding her jewels and educational certificates and therefore, called for enquiry on 23.09.2023 and again on 26.09.2023. The complainant and the petitioners are present on 23.09.2023. Thereafter, they called and appeared for enquiry on 26.09.2023, on that day, the petitioners were present and stated that, they are not withholding any property or educational certificates of the complainant and the same was recorded. When they contacted the complainant over phone, she did not turn up for enquiry on 26.09.2023 and informed that, she will pursue her remedy before the Competent Court.

The learned Government Advocate (Crl.Side) further submits that, 2/4
the petitioners were never harassed and they were only called for participation for the enquiry. Since the complainant herself reported that, she will workout her remedy before the Competent Court, the complaint will be closed accordingly after giving one more opportunity to the defacto complainant. 4.
In the light of the above facts, this Court finds that there was no harassment except calling the petitioners to participate in the enquiry and now it is given to understand that the presence of the petitioners is no more required in view of the oral statement given by the complainant. Therefore, this Court is of the view that, no order is necessary and this Criminal Original Petition is closed recording the facts stated by the learned Government Advocate (Crl.Side).
