This application has been filed to recall the sum of Rs.56,78,954.44 deposited in FDR in Bank of India, Egmore Branch, Chennai and order payment of Rs.43,10,000/- by drawing a cheque in the name 1st petitioner and reinvest the balance amount in the said bank for further period.

2. O.P.No.171 of 2002 was filed by the applicants seeking permission to sell the trust property and the O.P. was allowed on 09.07.2002 permitting the applicants to sell the property for a total sale consideration of Rs.1,75,70,000/- with a further direction to deposit the sale proceeds in anyone of the Nationalised Bank.

3. In pursuance of the order, the property was sold and money was deposited in the Bank of India, Egmore Branch. Subsequently, the applicants filed applications for payment out of money for the purpose of investment in different properties and for putting up construction of place of worship and

the Application Nos.909 of 2003, 133 of 2005, 57 of 2008 and 6348 of 2017 came to be allowed.

4. Mr.Devadason and Sagar, learned counsel for the applicants would submit that by resolution dated 10.06.2016, it was resolved to purchase a property in East Godavari District measuring an extent of 484 sq.yards and they need Rs.43,10,000/-.

5. Considering the above facts and submissions of the learned counsels and the reasons stated in the affidavit, this application is allowed. 28.11.2019 pvs
