O R D E R

This Criminal Original Petition is filed for speedy disposal of the Crl.A.No.42 of 2022 pending on the file of the 5th Sessions Judge, Kancheepuram District at Chengalpattu.

2. The learned counsel appearing for the petitioner states that the 1/4

appeal is adjourned from time to time for want of records in the trial Court. The trial Court in C.C.No.132 of 2020 ended in conviction vide judgment dated 03.08.2022.

3. Being aggrieved, the accused has preferred Crl.A.No.42 of 2022 and same is pending. The petitioner herein, who is the complainant, succeeded in the trial Court and due to pendency of the Criminal Appeal, he could not breath the benefit of the trial Court judgment.

4. It is unfortunate that the trial Court even after one year has not forwarded the records to the appellate Court, which is the cause for the delay. Therefore, it is necessary to direct the Principal District Judge to call for the records from Judicial Magistrate, Alandur in C.C.No.132 of 2020 and take up the appeal as per seniority and dispose it.

5. With the above direction, this Criminal Original Petition is disposed of.
