Respondents PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to consider and pass orders on the petitioner's representation dated 17.07.2025 with regard to register the sale deed presented by the petitioner on 14.05.2025 before the 2nd respondent and return the same to the petitioner within a stipulated time as fixed by this Honourable Court. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of mandamus to direct the respondents to register the sale deed which is stated to have been presented by the petitioner on 14.05.2025 before the 2nd respondent based on the petitioner's representation dated 17.07.2025.

It is submitted by the learned counsel for the petitioner that the petitioner is the absolute owner of property comprised in S.No.248, measuring to an extent of 600 sq.ft situated at Vellegaundanpalayam Village, Dharmapuri District. The grievance of the petitioner is that the petitioner intended to sell the property and presented a sale deed for execution after paying valid stamp duty before the second respondent on 14.05.2025. However, the same has not been registered or returned by the 2nd respondent till date. Hence, the petitioner has given representation dated 17.07.2025 before the 2nd respondent seeking registration of the sale

deed and return of the documents. However, the said representation has not been considered so far. Aggrieved by the same, the petitioner has come before this Court.

At the outset, Learned Special Government Pleader for the respondents would submit that if the sale deed is presented, the same would be registered, if it is otherwise in order within a time frame, to be fixed by this Court. If for any reason, registration of sale deed is sought to be refused, they would do so after assigning appropriate reasons.

5. In view thereof, this Writ Petition stands disposed of, with the following directions:

a) If the sale deed dated 14.05.2025 had been presented for registration and kept pending the same shall be registered if it is otherwise in order.

b) If for any reason the sale deed is sought to be refused registration the concerned authority shall assign reasons and issue refusal

slip/order.

c) It is made clear that, this Court has not expressed any views with regard to the merits of the case and it is open to the respondent concerned to consider the matter on its own merits and in accordance with law. No costs.

6. There will be no order as to costs.
