The petitioner, the 2nd accused in Crime No.281 of 2023 registered by the respondent police for the offence punishable under Sections 294(b), 323 and 307 of IPC, who had been arrested and remanded to judicial custody on 25.07.2023, seeks bail.

2. The case of the prosecution is that the first accused, who was addicted to alcohol, demanded money from the defacto complainant and when she had refused to give money the petitioner along with other accused picked up a quarrel with her. During the quarrel, the accused had abused the defacto complainant in filthy language and assaulted her by strangling her neck. Hence, the case.

3. It is contended by the learned counsel for the petitioner that the first accused had strangled the throat of the defacto complainant and the petitioner/A2 was only standing in the place of occurrence and he has

nothing to do with the alleged offence. Hence, he prays for grant of bail to the petitioner.

4. It is stated by the learned Government Advocate (Crl. Side) for the respondent that the petitioner along with other accused, under the influence of alcohol, demanded money from the defacto complainant, when she refused the same, the accused had abused her in filthy language and assaulted her by strangling. Hence, he vehemently opposed to grant bail to the petitioner.

5. Taking into consideration the gravity of offence, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
