The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 498(A), 294(b), 506(2) IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.8 of 2023, seeks anticipatory bail.

2.The petitioner is the 1st accused. It is stated that the defacto complainant is his own wife. He had married the defacto complainant on 22.01.2018. He has been working as call taxi driver. The defacto complainant is also a relative to the 1st accused. 3.It is the case of the prosecution that the petitioner herein was impotent and to cover that, he had harassed the defacto complainant. It is stated that treatment was taken by the petitioner, but it was futile.

smv Thereafter, there was demand for dowry. It had also been stated that the defacto complainant had filed D.V.C.No.111 of 2022, questioning which, the mother of the petitioner herein had filed C.R.P.No.15 of 2023 which is pending before this Court. The petitioner herein had filed O.P.No.1095 of 2022 pending before the III Additional Family Court, Chennai, seeking restitution of conjugal rights, but that had been filed after the defacto complainant had filed application under Domestic Violence Act. 4.Taking the seriousness of the allegations, this Court is not inclined to grant anticipatory bail to the petitioner herein.
