The applicant is the successful plaintiff. The suit was decreed on 01.12.2020 directing the defendant to pay a sum of Rs.38,27,139/- with further interest at the rate of 6% per annum on the sum of Rs.13,52,346/- from 01.12.2020 till the date of realization. 2. Meanwhile, as a condition for the grant of interim stay in such appeal, the defendant was directed to deposit a sum of Rs.6,76,173/- to the credit of the suit. In compliance, such deposit was made. Therefore, the applicant / plaintiff seeks permission to withdraw the said sum. The applicant has also placed on record the certificate of funds showing that the sum of Rs.6,76,173/- is now standing to the credit of the suit and that the said sum bears no interest. In the facts and circumstances outlined above, this application is liable to be allowed. Learned counsel for the defendant also has no objection to the application being allowed.
