PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the respondents 1 to 3 to give police protection during the Sri Chamundeeswari Temple Festival to be held on 06.10.2019 and 07.10.2019 to the petitioner and his family members and also consider the representation dated 27.09.2019 given by the petitioner.

O R D E R

This petition has been filed seeking to direct the respondents 1 to 3 to give police protection during the Sri Chamundeeswari Temple Festival to be held on 06.10.2019 and 07.10.2019 to the petitioner and his family members and also consider the representation dated 27.09.2019 given by the petitioner.

1. In connection with conduct of a Temple Festival, the petitioner apprehends that there could be disturbance from the respondents 4 to 14 herein and as therefore, filed the present petition seeking for protection.

The issue, as to whether such a protection can be given or not, requires to be determined, after hearing the objections of all the parties concerned and therefore, it would be appropriate to direct the 3rd respondent herein to consider the objections and then act on the petitioner's complaint, which is said to be given to the 3rd respondent on 27.09.2019.

4. In the light of the above observations, there shall be a direction to the 3rd respondent to consider the petitioner's complaint dated 27.09.2019, on its own merits and pass appropriate orders, after giving due opportunity to the petitioner as well as the respondents 4 to 14. Since the festival commences on 06.10.2019, the 3rd respondent herein shall endeavor to pass final orders, before 06.10.2019.
