PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to call for the records and quash the FIR in Crime No.335 of 2018 dated 29.11.2018 filed by the respondent police for alleged offences under Section 341, 392, 506(ii) of IPC. ORDER

The petition is filed to quash the FIR in Crime No.335 of 2018 registered on 29.11.2018 by the respondent police for the alleged offence under Sections 341, 392 and 506(ii) IPC.

2. The learned counsel appearing for the petitioner would submit that the petitioner who belongs to political party used to question the excessive action of the police, therefore, criminal cases are being foisted against him using stock witnesses. The learned counsel submitted that even after 5 years of registration of the said complaint, the police has not filed the final report but the learned Government Advocate (Crl.Side) states that the final report is ready and will be filed soon. Thus, as on date, the investigation is not yet completed and he also submitted that to damage the political prospection of the petitioner and to slap preventive detention on him, case has been put up.

This Court on perusing the First Information Report finds that an Auto driver was restrained by group of four persons came in Maruthi Esteem Car and on knife point, a sum of Rs.1,500/- robbed from him. On hearing the hue and cry of the auto driver, public gathered, apprehended the persons and handed Page No.2/4

them over to the police. This petitioner is one amongst the four persons. This Court finds no reason to interfere the investigation though there is some delay in completing the investigation.

4. Recording the submission made by the learned Government Advocate (Crl.Side) that investigation completed and within three days the final report will be filed.
