O R D E R

(The order of the Court was made by J.Nisha Banu,J.) This Writ Petition has been filed to direct the respondents to effectively and efficiently diagnose and treat the petitioner as an in-patient in any reputed Hospital.

2. Learned counsel for the petitioner would state that the petitioner is the friend of the detenu. He would further state that many false cases have been foisted against the detenu and he is detained in Central Prison, Coimbatore. The detenu is suffering from various ailments and there is no proper treatment given to him in the Central Prison and hence, treatment as an in-patient in any reputed Hospital is necessary. Though he had sent various representations to the Prison Authorities and to the Government in this regard, no action was taken so far. Hence, the present petition with the aforesaid relief.

3. Learned Additional Public Prosecutor would state that the detenu is a Maoist and he is involved in more than 15 cases for the offences under 2/5

the Indian Arms Act and Explosive Substances Act and the charge sheet had been filed in six cases and in other cases, charge sheet are yet to be filed. He would further state that proper medical treatment is being given to all the prisoners including the detenu by the medical officers and specialists and there is no need of treatment to the detenu as an in-patient in any reputed Hospital.

Considering the above submission made by the learned Additional Public Prosecutor and the factual aspects of the case, when we are inclined to dismiss this writ petition, at this juncture, the learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition. He has also made an endorsement to that effect in the Court bundle.

5. In view of the above submission and endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as withdrawn. No costs.
