This petition is filed under Article 226 of The Constitution of India praying to issue a Writ of Mandamus directing the respondents to consider to absorb the petitioner as she has worked as temporary staff appointed for Tsunami Relief Works, on

temporary basis and consolidated pay and to provide alternative employment in any of the vacancies arose in future in Government Departments as per the G.O.(Ms) No.105 issued by the Ist respondent dated 26.02.2016.

By consent, the writ petition is taken up for final disposal.

2. The petitioner claims that she is a Diploma holder in Civil Engineering and registered her name in the Department of Employment and Training, District Employment Office, Kanchipuram, and she was called for the interview for the post of Technical Assistant in Kanchipuram District Tsunami Project Execution Unit. After undergoing the selection process in the form of interview, she was appointed as Technical Assistant under the Tsunami Emergency Reconstruction Project by proceedings of the 5th respondent dated 26.10.2007 and she was working in that capacity from 12.11.2007 and she was paid with a consolidated pay of Rs.4,000/- per month and all of a sudden, vide proceedings of the 6th respondent dated 02.02.2008, she was terminated from service with effect from 31.01.2008.

Learned counsel appearing for the petitioner would submit that the persons who are similarly placed had approached this Court by filing W.P.No.28106/2013 and by an order dated 05.11.2013, this Court, while disposing of the writ petition has taken note of G.O.Ms.No.332 Revenue Department dated 16.07.2010 and passed an order of absorption and the said order has also been complied with in G.O.(Ms) No.105 dated 26.02.2016. The petitioner in this regard has also submitted a representation dated 30.03.2016 to the 5th respondent which is yet to be disposed of and hence, prays for appropriate orders.

4. This Court heard Mr.K.Dhananjeyan, learned Special Government Pleader, who accepts notice on behalf of the respondents.

5. Though the petitioner prays for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the claim made by the petitioner in the form of the representation or in the writ

petition, directs the 5th respondent to consider and dispose of the petitioner's representation dated 30.03.2016 on merits and in accordance with law and pass orders within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.
