This Criminal Original Petition has been filed by the petitioner seeking to call for the records in C.C.No.26 of 2008 on the file of the learned Judicial Magistrate - I, Coimbatore and to quash the same.

2. When the matter is taken up for hearing, learned counsel for the petitioner seeks time. Learned counsel for the respondent would submit that the Criminal Complaint is of the year 2008 and the trial in the case has been completed and it is now posted for arguments on the side of the petitioner / accused, however, citing the pendency of the Criminal Original Proceedings, the petitioners / accused are not proceeding with the matter.

3. Taking into consideration the fact that the trial in the case has been completed and now the case stands posted for arguments on the side of the petitioners, this Court finds that no purpose would be served by keeping the quash petition pending.

4. In view of the above, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
