ORDER

This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime NO.34 of 2025 pending on the file of the respondent.

2. The case of the prosecution is that due to previous enmity, on 07.06.2025, the petitioners are alleged to have abused the defacto complainant in filthy language, thrown chilli powder into his eyes, assaulted him and criminally intimidated him by showing a wooden stick.

3. The grievance of the petitioners is that they have not committed any such offence as alleged by the defacto complainant. Only in order to dilute the crime committed by the defacto complainant, a false case has been foisted against them and they have also lodged a counter complaint against the defacto complainant.

4. The learned Government Advocate(crl.side) appearing for the respondents would submit that there is a case and a counter case.

5. On perusal, it is seen that both the parties attacked each other, and sustained injuries.

6. In such view of the matter, this Court is of the opinion that the matter requires thorough investigation by the investigating officer, who shall ascertain the facts and file a final report. At this stage, the FIR cannot be quashed.

7. Accordingly, this Criminal Original Petition is dismissed. 29-08-2025 mrp To The Sub Inspector of Police, Thoothur Police Station, Ariyalur District.
