In a proposed suit for relief in respect of alleged infringement of the first plaintiff's registered design, the intending plaintiff seeks leave to sue the respondent before this Court. Upon examining the draft plaint and documents relating to the sale of the allegedly infringing product within the jurisdiction of this Court, it appears that at least a part of the cause of action has arisen within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to the applicant to sue the respondent before this Court. Consequently, the Registry is directed to number the suit, if otherwise in order.
