Petition filed under Section 528 of BNSS calling for the records and quash the Charge sheet in S.C.No.118 of 2024 on the file of the learned Sessions Judge, Fast Track Mahila Court, Krishnagiri District in respect of the petitioners/accused are concerned. O R D E R

The petition is to call for the records in SC.No118 of 2024 on the file of the learned Sessions Judge, Fast Track Court Mahila Court, Krishnagiri District on the ground of compromise between the parties.

2. It can be seen that the case is initiated on the complaint of the Village Welfare Officer, whereby the incident of child marriage was brought on record. In this case, the marriage took place on date 22.08.2023. On the said date, the bride was of sixteen years of age and therefore the complaint was made pursuant to which, the final report is also filed when the case is pending trial. Now, the child has attained majority and both the child as well as her husband are living together as any other husband and wife. The parents of the bride and the groom are being prosecuted.

3. Considering the overall facts and circumstances of this case and the social background of the parties and the present circumstances and the future of the parties, I am of the view that this is the fit case to invoke the jurisdiction of this Court under Section 482 of the Code of Criminal Procedure and quash the case. Accordingly, the proceedings in 2/4

SC.No.118 of 2024 shall stand quashed and consequently the Criminal Original Petition stands allowed.
