ORDER
The petitioner, who was arrested and remanded to judicial custody on 02.12.2024 for the alleged offence under Section 8(c) r/w 20(b)(ii)(C), 28 and
29 of the NDPS Act altered as Section 8(c) r/w 20(b)(ii)(c), 23(c), 25, 27(A), 28, 29 and 30 of NDPS Act @ under section 20(b)(ii)(c), 23(c), 25, 27(A), 28 and 29 of NDPS Act as per charge sheet on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the Accused were found in possession of 848 kgs of Ganja along with a cellphone. Totally, there were four accused. The petitioner is arrayed as A2. The contraband had been seized by the respondent police. Hence, the case.
3. The learned counsel for the petitioner has fairly concedes that the case involves a commercial quantity of 848 kgs of Ganja.
4. The learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and opposed the grant of bail to the Petitioner.
5. I have given my anxious consideration to either side submissions and perused the materials available on record.
6. From the submissions made by the learned counsel on either side, it is evident that this case involves 848 kgs of Ganja and the quantity involved is a
commercial quantity. This Court could not find any material to over come the rigour of section 37(1)(b)(ii) of the NDPS Act. In such view of the submission, this Criminal Original Petition is dismissed. 17-03-2026 SHL To:
