COMMON ORDER (TM) A.No.103 of 2024 in O.P(TM) No.7 of 2023 has been filed seeking leave of this Court to produce additional documents in respect to the documents disclosed in the schedule to Judges summons.
2. (TM) A.No.104 of 2024 in O.P(TM) No.7 of 2023 has been filed seeking leave of this Court to let in secondary evidence in respect of documents mentioned in the schedule to Judges summons.
3. Learned counsel for the respondents in the aforementioned applications would submit that the applications may be allowed and the documents may be received subject to its admission, proof and relevancy and similarly, the applicant/petitioner may be permitted to let in secondary evidence in respect of documents in Schedule-A to the Judges Summons subject to its admission, proof and relevancy. Accordingly, both these applications are allowed as prayed for. However, additional documents are allowed to be received and the 2/4
applicant/petitioner is allowed to let in secondary evidence subject to its admission, proof and relevancy. The respondents are permitted to raise all objections with regard to the documents during the cross-examination of the petitioner's witness and during the arguments in the main suit.
