Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 3,4 respondents to implement the recommendation by the second respondent in Letter No.6006/DHFWS/BME/E3/Complaint/2025-26/246 dated 31.07.2025 to declare the petitioner's result vide Registration No.20770483 further to participate in the supplement examination with practical conducted on 18.08.2025 as far as possible.

ORDER

This writ petition has been filed for direction directing the respondents to implement the recommendation by the second respondent dated 31.07.2025 to declare the petitioner's result and also to participate in the supplement examination with practical conducted on 18.08.2025.

The petitioner had joined in the sixth respondent institution for MBBS Course through CENTAC management committee and the fee is fixed by the government at Rs.16,00,000/- per year. However, the petitioner did not pay the fees and he is in due to the sixth respondent. Therefore, the sixth respondent did not permit the petitioner to attend the classes and also did not permit him to write the examinations. After obtaining the orders from this Court, the petitioner attended the classes and also wrote the examination. However, the internal assessment is with the sixth respondent and until otherwise internal assessment marks submitted to the fourth respondent, the fourth respondent cannot publish the results.

While pending the Writ Petition, the petitioner was also permitted to attend the practical classes held on 18.08.2025 for his supplementary examinations. However, the final year MBBS result of the petitioner is not yet published.

The learned counsel appearing for the sixth respondent submitted that the sixth respondent is ready to submit internal assessment mark of the petitioner on condition that the petitioner shall pay his due within the stipulated time.

Considering the above submissions, the petitioner is directed to execute undertaking affidavit to pay balance fee of Rs.43,00,000/- within a period of eight weeks from the date of receipt of a copy of this Order. On receipt of the said undertaking affidavit, the sixth respondent is directed to furnish the internal assessment mark of the petitioner to the third respondent, forthwith. In turn, the respondents 3 & 4 shall publish the results of the petitioner for the final year MBBS examination within a period of two weeks thereafter. 6.

With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs.
