The prayer in the writ petition is to issue a Writ of Declaration, proceedings of the first respondent dated 21.06.2019 in Na.ka.No.7451 of 2018 and declare the same as null and void as Arbitrary, violative of principles of natural justice contrary to law and established legal practices.
2. Heard Mr.P.B.Sampath Kumar, learned counsel appearing for the petitioners and Mr.D.Raja, learned Additional Government Pleader, who takes notice for the respondents.
3. This writ petition is filed pointing out some error in the arbitration award passed by the District Collector arising out of National Highways Act,1956. Since the National Highways Act, 1956 as well as the Arbitration and Conciliation (Central Act 26/1996) Act 1996 gives appeal remedy before the District Court, this Court is not inclined to entertain the writ petition.
4. Hence, this Writ Petition is dismissed. All the points raised by the petitioners herein can be canvassed before the District Court. If any petition is filed before the District Court, the same may be taken on file and disposed of as expeditiously as possible preferably within a period of six months from the date of filing the petition. No costs.
