praying for issuance of a writ of Mandamus, directing the respondents herein to disburse all monetary benefits and all other eligible benefits of the paternal uncle namely A.Murugesan, (late)Assistant Engineer(Section.110/22/KV/SS/VALAYAPATTY, Station, Namakkal )to the petitioner along with appropriate rate of interest based on the representation made by the petitioner dated 14.12.2023 within in time frame.

O R D E R

The writ petition has been filed for the following reliefs:- "directing the respondents herein to disburse all monetary benefits and all other eligible benefits of the paternal uncle namely A.Murugesan, (late) Assistant Engineer (Section.110/22/KV/SS/VALAYAPATTY, Station, Namakkal )to the petitioner along with appropriate rate of interest based on the representation made by the petitioner dated 14.12.2023 within in time frame."

2. The petitioner would submit that her paternal uncle one 2/6

A.Murugesan who was working as an Assistant Engineer Grade-I in the office of the 4th respondent died on 02.04.2019 due to health issues. The petitioner would submit that the deceased Murugesan's father died on 02.11.2010, his mother died on 26.10.2015 and his brother died on 08.11.2020.

3. The petitioner would submit that since there is no first class legal heir of the deceased A. Murugesan, the petitioner and her sister had filed a suit OS.No.28 of 2020 on the file of the Principal District Munsif Court, Kallakurichi declaring that they are entitled to receive monetary benefit and compassionate appointment of the deceased employee A.Murugesan. The suit was decreed in favour of the petitioner by judgement and decree dated 26.07.2023.

Thereafter, the petitioner had made a representation dated 14.12.2023 to the respondents seeking to disburse all monetary benefits and all other eligible benefits of the paternal uncle, namely, A.Murugesan. However, to date, the said representation has not been disposed of. Hence the Writ Petition.

5. Heard the counsels on either side.

Considering the facts and circumstances of the case and taking into account the fact that the respondents, who are bound by the decree in OS.No.28 of 2020 on the file of the Principal District Munsif, Kallakurichi have failed to discharge their obligation and the petitioner's representation dated 14.12.2023 has not been disposed of by the respondents to date, the Writ Petition is allowed and a direction is issued to the respondents to consider the representation of the petitioner dated 14.12.2023 and pass orders in accordance with law within a period of two months from the date of receipt of a copy of this order.
