The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(aaa) and 4(1-A) of TNP Act in Crime No.267 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner along with her son were found to be in illegal possession of 70 litres of ID arrack in their house. Hence, the complaint.
3.The learned counsel for the petitioner would submit that this is the second application for anticipatory bail and while dismissing in the earlier application in respect of this petitioner, this Court has granted anticipatory bail to her son in Crl.O.P.No.23259 of 2022. 4.Per contra, the learned Government Advocate (Crl. Side) would submit that the petitioner is a habitual offender against whom there are five previous cases similar in nature pending against her. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner. 5.Taking into account the nature of offence and the previous antecedents of the petitioner and there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
