C.M.P.No.23275 of 2023 in CMA.Sr.No.1143 of 2023 N.ANAND VENKATESH , J When the matter was taken up for hearing, it was brought to the notice of this Court that the 1st respondent/claimant died in the year 2017 itself. However, it was not brought to the notice of the Tribunal and therefore, the Tribunal proceeded to pass the Award on 29.03.2021 in favour of both the claimants. This fact came to light only recently. The learned counsel for the 2nd respondent submitted that apart from the deceased daughter, there are two sons for the 1st and 2nd claimants. The particulars of these two sons was also given to the learned counsel for the appellant. The learned counsel for the appellant seeks for some time to file a petition to implead the legal representatives of the deceased 1st respondent. 2.Post this case on 30.07.2024. In the meantime, necessary petition shall be filed.
