This petition is filed under Article 226 of The Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records of the order of the 3rd respondent dated 09.11.29016 in g/K/1221-2016-m and quash the same and consequently restore the petitioner's patta No.4231 of 2014. O R D E R

After some arguments, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to file an Appeal before the District Revenue Officer, Kanchipuram and accordingly, made an endorsement.

2. This Court, heard the submission of Mr.P.V.Selvakumar, learned Additional Government Pleader appearing for the respondents.

3. In the light of the endorsement made in the writ petition, the writ petition is dismissed as withdrawn with liberty to the petitioner to file an appeal before the District Revenue Officer, Kancheepuram District, challenging the legality of the order of the Revenue Divisional Officer, Tambaram, Kanchipuram District, the 3rd respondent herein dated 09.11.2016 within a period of two weeks from the date of receipt of a copy of this order and upon filing an appeal, the same shall be entertained by the District Revenue Officer, Kancheepuram District if the papers are otherwise in order and dispose of on merits and in accordance with law as expeditiously as possible. No costs.
