Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to include the petitioner in the list of eligible candidates who are deemed to have the benefit of the Judgment dated 10.07.2024 passed by this Court in Writ Petition Nos.26084, 26133, 27571, 27807, 28291, 32081, 32218, 32698 and 35350 of 2023 wherein the State Government was directed to continue the process of appointment left midway in 2017, insofar as the petitioners are concerned and appoint them as Secondary Grade Teachers, or Graduate Assistants as the case may be, as expeditiously as possible, without causing any further delay, if they are otherwise eligible for appointment as per the eligibility criteria laid down by the NCTE, and to appoint them as teachers depending on their respective merit / ranking as per the weightage method and their TET scores, applying the rule of reservation accordingly and to therefore extend the scope and benefit of 1/4

the said Judgment dated 10.07.2024 to the petitioner herein. For petitioner :

O R D E R

This writ petition has been filed for a direction to the respondent to include the petitioner in the list of eligible candidates who are deemed to have the benefit of the judgment dated 10.07.2024 passed by this Court in Writ Petition Nos.26084, 26133, 27571, 27807, 28291, 32081, 32218, 32698 and 35350 of 2023.

2.The issue that is involved in this writ petition was already considered by the learned Single Judge of this Court in W.P.No.161 of 2024. By order dated 08.01.2024, the writ petition was dismissed. Following this order, yet another order was passed by this Court in W.P.No.6245 of 2024, dated 11.03.2024.

3.The learned counsel for the petitioner further submitted that the name of the petitioner was declined after the orders were passed by this Court and therefore, the petitioner is entitled for the same relief that was 2/4

granted to the petitioners in the Writ Petitions which was allowed by the Division Bench.

4.In the considered view of this Court, this Court would have granted the relief sought for by the petitioner for a mere asking if not for the observation made at paragraph No.36. The petitioner has to necessarily seek for a clarification from the Division Bench. This Court cannot issue a direction which will run contrary to the observation made by the Division Bench.

5.In the light of the above, there is nothing to be considered in this writ petition and this writ petition must also fail in the light of the order passed in W.P.No.161 of 2024, dated 08.01.2024 and accordingly, this Writ Petition stands dismissed. No costs.
