PRAYER : The writ petition has been filed under Article 226 of the Constitution of India for issuance of writ of Mandamus directing the respondents 1 to 3 to restore the electricity service connection in SC.No.09545-002-847 at the shared household situated at No.1/25, Vellalar Street, Kumaracheri Village, Koovam Post, Tiruvallur District - 631 402 within a time fixed by this Hon'ble Court.

ORDER

The writ petition has been filed to direct the respondents 1 to 3 to restore the electricity service connection in SC.No.09-545-002-847 at the shared household situated at No.1/25, Vellalar Street, Kumaracheri Village, Koovam Post, Tiruvallur District - 631 402.

2.The case of the petitioner is that the 4th respondent is the husband of the petitioner and the 5th respondent is the father-in-law of the petitioner

and the marriage between the petitioner and the 4th respondent was solemnised on 21.02.2022 and out of the wedlock, they were blessed with a female daughter. While so, due to some matrimonial dispute, the 4th respondent abandoned the petitioner and her daughter and the 4th and 5th respondents are residing together in the other house owned by the 5th respondent. Thereafter, in order to wreck vengeance, the 4th and 5th respondents disconnected the electricity of the house in which the petitioner is continuing to reside along with 15 months old child. Thereby, the petitioner made several representations seeking to restore the electricity connection, which evoked no response. Hence, this present writ petition. 3.The learned counsel for the petitioner submitted that this Court by an order dated 27.09.

2024 has granted interim order directing the respondents Electricity Board to restore the electricity service connection of the subject house in which the petitioner is residing by that day itself. In this regard, the respondents Electricity Board had complied with the order of this Court dated 27.09.2024.

4.The learned Standing Counsel Mr.L.Jai Venkatesh appearing for the respondents 1 to 3 (TNEB) submitted that as per the order of this Court dated 27.09.2024, service connection was restored on that day itself. 5.The learned counsel appearing for the 5th respondent would submit that there was a matrimonial dispute between the petitioner his daughter-inlaw and the 4th respondent his son. The petitioner insisted the 5th respondent not to reside along with the 4th respondent. Further, he submitted that the service connection of the petitioner's house was restored as per the order of this Court. Therefore, he prayed that liberty may be granted to work out his remedy before the competent civil court.

6.Heard the learned counsel for the petitioner and the learned standing counsel for the respondents 1 to 3 as well as the learned counsel for the 5th respondent and perused the materials available on record.

7.Since the service connection was restored to the house of the petitioner, no further adjudication is required in this writ petition. Accordingly, this writ petition is closed with liberty to the 5th respondent to approach the competent civil court to workout his remedy with regard to the shared household in the manner known to law. No costs. Consequently, connected miscellaneous petition is closed.
