This petition has been filed to relax the condition in para No.7(ii), imposed by this Court vide order dated 15.04.2019 made in Crl.M.P.No.3801 of 2019 in Crl.A.No.142 of 2019.

2. The petitioner seeks relaxation of the condition. The condition was imposed in the year 2019 directing the petitioner to appear before the trial Court on the first working day of every English calendar month. Learned counsel for the petitioner submitted that the petitioner has been regularly appearing before the trial Court without fail. The petitioner is a seaman. His nature of job is that he has to travel and stay on board in a ship for months together. Due to the above condition, the petitioner is unable to get employment. He is the sole bread winner of his family and having permanent residence at Tirunelveli. He further submitted that the petitioner will not be reason for the delay or seek adjournment, when the appeal is taken up for final hearing. Hence, he prays to relax the condition imposed on 15.04.2019.

5. Learned Special Public Prosecutor appearing for the respondent submitted that the petitioner is complying with the condition without any deviation.

6. Considering the facts and circumstances of the case and also considering the submission made by the learned Special Public Prosecutor that the petitioner is complying with the condition without any deviation, the condition imposed on the petitioner to report before the trial Court, is relaxed.
