Prayer :- Criminal Revision filed under Sections 397 and 401 of the Criminal Procedure Code, to set aside the order of dismissal passed in Crl.M.P.No.2269 of 2015 dated 23.11.2015 on the file of Principal District and Sessions Judge at Thiruvallur and to condone the delay of 111 days in filing the Criminal Appeal. The accused is the revision petitioner herein.
2. The respondent herein who is the complainant, filed S.T.C.No.510 of 2014 before the learned Judicial Magistrate, Fast Track Court, Ambattur for alleged offence under Section 138 of N.I.Act. After trial, it ended in conviction. The accused preferred Crl.A before the learned Principal District Judge, Tiruvallur in C.A.SR.No.2471/2015 since there was a delay of 111 days in filing the said appeal, to give an opportunity to the appellant/accused, he was directed to pay Rs.50,000/-. The conditional order was not complied with inspite of specific direction.
3. Accordingly, the appeal was dismissed. Aggrieved by the said dismissal, the accused has preferred this criminal revision. No plausible explanation was offered for non-deposit of the amount. Hence, I do not find any merits in this revision. https://hcservices.ecourts.gov.in/hcservices/
4. Accordingly, this criminal revision is dismissed. Consequently, connected Crl.M.P is closed.
