..Respondent(s) PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the 1st respondent to forthwith disburse the petitioners lawful and rightful 1/4th share in the terminal benefit accrued by the deceased employee late K.S.Rajendran along with pension, in accordance with the order dated 18.09.2018 passed in S.O.P. No.55 of 2017 on the file of the Honble district court, Tiruppur by treating the
petitioner as one of the class-I legal heirs of Late K.S.Rajendran by appreciating the above stated facts.

ORDER
The grievance of the petitioner in this writ petition is that the Civil Court has passed an order in S.O.P.No.55 of 2017 declaring that the petitioner herein who is the second respondent therein as one of the legal heirs of the deceased K.S.Rajendran along with the second and third respondents herein and the deceased K.S.Rajendran's mother Leelavathi and is entitled to an equal share in the schedule properties of the deceased husband. The first respondent herein has disbursed the shares of the respondents 2 and 3 herein and the said Leelavathi along with the other terminal benefits of the deceased K.S.Rajendran. However, the petitioner is alone is denied to the remaining 1/4th share. 2.The petitioner made several requests to the respondents to disburse her share.
In response to the petitioner's request, the respondents demanded that she should produce further documents including the fact that she is unmarried along with the death certificate, legal heir certificate, aadhar card, pan card, etc., This request of the respondents is totally contrary to the orders passed by the learned Principal District Judge, Tiruppur, in S.O.P.No.
not required in the light of the fact that the respondents have already partly complied with the order. The said death certificate, legal heir certificate were already produced by the second and third respondents and the said Leelavathi and on the basis of which, the amounts were disbursed to them. Already, 3/4th share of the amount have been disbursed to them taking into account the order passed in the aforesaid succession original petition. In the said petition, the learned Judge had clearly come to the conclusion that the petitioner is also a legal heir of the deceased K.S.Rajendran and entitled to 1/4th share in his properties. Such being the case, refusal to register the same and failing to disburse the said amount is violative of the orders of the Court. Considering the above facts, the petitioner is directed to produce an affidavit and pan card if available to the respondents along with her bank account and on the receipt of the same, the respondents are directed to disburse the same within a period of two weeks therefrom. Accordingly, this writ petition is allowed. No costs.
