O R D E R
The petitioner herein is the first accused in CC No.7 of 2021 pending on the file of the Inspector of Police, W-30 AWPS - Poonamallee Police Station.
2. The lookout circular has been issued against her in view of the pendency of the criminal case. Hence she has filed the present petition to withdraw the lookout notice issued against her and permit her to go to Canada, since she has to vaccinate her child was born in Canada.
3. The learned Government Advocate (Crl. Side), had a strong objection for withdrawal of the lookout notice on the ground that the trial in this case is almost at the verge of completion and adjourned for examination of I.O.
4. The learned counsel appearing for the petitioner submits that lookout notice atleast be suspended for a short period between 05.10.2024 and 25.10.2024, to enable the petitioner to take medical care 2/5
of her child. An affidavit is filed by the petitioner informing about her travel details with an undertaking to return back to India on 25.10.2024. The travel tickets of the petitioner, from Chennai to Canada and return ticket from Canada to Chennai, have also been furnished along with the affidavit.

Considering the reasons stated by the petitioner in her affidavit to go Abroad and the preparation made by her, for her travel, the Criminal Original Petition is disposed of with the following directions: (i) The petitioner herein shall be permitted to go to Canada and return to India as per the travel tickets i.e. 05.10.2024 to 25.10.2024. Before leaving India, she shall file memo before the Trial Court about her place of stay at Canada and Conduct Number.
(ii) Immediately on landing at Canada she shall report to the Indian Embassy at Toronto about her arrival and before leaving Canada, she should report to the Indian Embassy about her departure and soon after landing India, she should report to the Trial Court 3/5
about her arrival and continue to participate in the trial without fail.
6. It is made clear that the lookout circular issued against the petitioner is directed to be kept in suspension between 05.10.2024 to 26.10.2024.
