Respondent Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the Respondent in Letter No: F2/2744/2018 dated 28.05.2019, quash the same and consequently direct the Respondent to dispose of the Appeal filed by the Petitioners herein on 05.02.2018 before the Respondent.

When it is pointed out that the cause of action for the Writ Petition has arisen in a property which is situated within the territorial limits of jurisdiction of the Madurai Bench of this Court, and the Petitioner had on earlier occasions chosen the Madurai Bench of this Court to ventilate the grievances has reflected in the order dated 01.08.2014 in Review Application (MD.) No. 23 of 2013 and the order dated 30.01.2013 in W.P. (MD). No. 13153 of 2012 and the doctrine of forum conveniens would desist this Court and subsequent Writ Petition filed by the Petitioner in respect of the same subject matter at the Principal Seat of this Court, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to approach the Madurai Bench of this Court by way of filing fresh Writ Petition for the same relief. He has also made an endorsement to that effect, which is recorded. https://hcservices.ecourts.gov.in/hcservices/

Accordingly, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
