O R D E R
The petitioner herein seeks a direction to respondents to issue patta in her name in respect of the property bearing Plot No.3 at Ayyappa Nagar Extension, Madipakkam, Chennai-600 091 comprised in S.No.174/2 in Madipakkam Village, Kanchipuram District.
2. It is the case of the petitioner that the above mentioned property along with larger extent of property owned by number of persons were declared as surplus land under Urban Land Ceiling and Regulations Act. The said notification was questioned by petitioner's father Sivaramakrishnan and others in writ petition in W.P.No.13863 of 2001. The said writ petition was allowed on 25.06.2010. Aggrieved by the same, the respondents in the said writ petition filed writ appeal in W.A.No.284 of 2018 and same was also dismissed. In fact, at the time of dismissing of writ appeal, the Division Bench of this Court directed the respondents therein to consider the applications made by the writ petitioners therein seeking mutation of revenue records. In spite of the direction, the respondents have not mutated the revenue records in favour of the writ petitioners therein. Therefore, the petitioner submitted a representation on 01.08.2024 seeking issue of patta in her name in respect of property in 2/4
Survey.No.174/2 at Madipakkam Village, Sholinganallur Taluk, Chennai District with an extent of 2560 Sq.feet. The said representation has not been considered by the respondents till date. Therefore, the petitioner is before this Court.
3. In view of the fact that the writ petition filed by the petitioner's father was allowed by this Court quashing the notification issued under Urban Land Ceiling Act, there may not be any impediment for the respondents to consider the representation of the petitioner seeking issuance of patta. Therefore, the 1st respondent is directed to consider the representation of the petitioner dated 01.08.2024 and pass final orders on its' own merits within a period of four weeks from the date of receipt of copy of this order.
4. With the above directions, this writ petition is disposed of. No costs. 01.10.2024 Index : Yes/No Internet : Yes/No Speaking Order/Non-Speaking Order : Yes/No nr 3/4
