Respondents Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to grant lease/permission to the petitioner for quarrying ordinary earth from the patta land (Applied Area) bearing S.F.No.116/3Aa, 119/1C, 120, 121/1B & 121/2B over an extent of 2.11.5 hectates in Vembedu Village, Uthukottai Taluk, Tiruvallur District, for a period one year for the quantity permitted in the E.C and also execute the agreement as per the Tamil Nadu Minor Mineral Concession Rules, 1959, within the time frame fixed by this Court.

This writ petition has been filed for issue of writ of mandamus directing the 2nd respondent to grant lease/permission to the petitioner for quarrying ordinary earth from the patta land belonging to the petitioner for a period of one year as per the Tamilnadu Minor Mineral Concession Rules, 1959. 2.When the matter was taken up for hearing, the learned Government Advocate appearing on behalf of the respondents submitted that based on the order passed by the Division Bench of this Court in W.P.No.1427 of 2025 dated 17.01.2025, the 1st respondent has initiated proceedings dated 24.01.2025, in order to assess illegal mining and to take action.
3.The learned counsel for the petitioner submitted that this direction will be applicable only in cases where there is illegal mining and whereas, in the case in hand, the petitioner wants to quarry ordinary earth from his patta land for a period 2/4
of one year and the permission was sought for. 4.Taking into consideration the facts and circumstances of the case and considering the submissions made on either side and the materials available on record, it will suffice if a direction is given to the 1st respondent to deal with the representation made by the petitioner on 11.07.2025 and convey the decision taken by the 1st respondent to the petitioner, within a period of four weeks from the date of receipt of copy of this order.
5.This writ petition is disposed of with the above directions. No Costs. 18.08.2025 Index : Yes/No ssr To 3/4
