Respondent Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus directing the respondent to appoint the petitioner for the post of Reserve Crew Conductor based on his representation dated 16.11.2016 within the time limit to be fixed by this Court.

By consent, the writ petition is taken up for final disposal.

Mr.P.Paramasivadoss, learned Standing Counsel accepts notice on behalf of the respondent.

The petitioner would state that he is having a valid Conductor License bearing No.Tamil Nadu 58/CL/0000117/2012 and registered his name in the District Employment Exchange. The respondent / Corporation had called for applications for filling up the post of Conductors and he applied for the same and he received a communication dated 29.11.2014 from the respondent stating that the date of interview is fixed on 17.12.2014 between 9.30 a.m. and 10.30 a.m. for filling up the vacancies for the post of Reserve Crew Conductor and the petitioner has also appeared before the concerned official at Ayanavaram Depot and participated in the interview and performed well.

The petitioner was selected as a Reserve Crew Conductor vide order dated 07.01.2015 and it was served on the petitioner only on 01.07.2015. The petitioner on account of the fact that he was taking treatment for Jaundice could not join duty and it was also informed to the respondent / Corporation through Letter dated 05.07.2015. The petitioner thereafter, appeared before the concerned official for the purpose of joining duty and he was informed that the joining order will be issued shortly and thereafter, nothing had fructified and therefore, the petitioner submitted a representation dated 16.11.2016 to the respondent / Corporation praying for permission to join duty in pursuant to the Appointment Order dated 07.01.2015 and though the representation was received and acknowledged, no orders have been passed and hence, he came forward to file the present writ petition.

Heard the submissions of the learned counsel for the petitioner and Mr.P.Paramasivadoss, learned counsel appearing for the respondent / Corporation.

Though the petitioner has prayed for a larger relief, this Court, in the light of the facts and circumstances and without going into the merits of the claim projected by the petitioner, directs the respondent / Corporation to consider and dispose of the petitioner's representation dated 16.11.2016 on merits and in accordance with law and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.

The writ petition stands disposed of with the above direction. No costs.
