The learned counsel for the appellant in W.A.No.975 of 2017 submitted that this writ appeal has been filed to set aside the order passed by this Court in WMP No.5673/2017 in W.P.No.25127/2016 dated 08.02.2017 as clarified by order dated 02.03.2017 by the appellant, who is a third party to W.P.No.25127/2016. He also submitted that the appellant died and inview of the same, the prayer sought for in the writ appeal has become infructuous and hence, nothing survives for further adjudication.

2. The learned counsel for the petitioner in W.P.No.5130/2019 submitted that, the prayer sought for in the writ petition also has become infructuous and hence, nothing survives for further adjudication.

3. Recording the submission made by the learned counsel for the appellant as well as the writ petitioner, the W.A.No.975/2017 and W.P.No.5130/2019 are dismissed as infructous. No costs.
