The petition is filed to condone the delay of 485days in filing the appeal.

2. The 1st respondent remained exparte before the Trial Court and hence, notice to 1st respondent is dispensed with.

3. The learned counsel for the 2nd respondent submits that petitioner/claimant is not entitled to claim interest for the delay period.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the delay is condoned.

Accordingly, the civil miscellaneous petition is allowed.

5.It is made clear that petitioner is not entitled to claim interest for the delay period.
