[Order of the Court was made by Dr.G.JAYACHANDRAN, J.] This Miscellaneous Petition has been filed to condone the delay of 257 days in filing the above appeal.

2. Mr.K.M.Venugopal, learned counsel appearing for the 1 st respondent and Mr.A.Edwin Prabhakar, Standing Counsel for Mr.M.V.Athi Seshan, learned counsel for the 2 nd respondent, have no objection for allowing this petition.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition and upon hearing the learned counsel appearing on either side, we are inclined to condone the said delay.

4. Accordingly, the delay of 257 days is condoned and the Civil Miscellaneous Petition is ordered.

5. The Registry is directed to number the Appeal Suit, if it is otherwise in order and list the same next week "

for admission"
