2. Heard the learned counsel for the petitioner and the learned counsel for the first respondent. The first respondent/ contesting respondent has no objection in allowing this petition.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 178 days in filing the appeal is condoned.
