In view of the order dated 30.01.2023 the accused has been secured and he is present today. However he has not chosen to settle the issue.

2. The learned counsel for the petitioner requested short accommodation for trying out settlement. He further submitted that the petitioner had also filed a memo of undertaking that he will be make his personal appearance during next hearing.

3. Records would show that the accused had not participated in the trial effectively and cross-examined P.W.1. The concurrent judgment of the Courts below confirms the guilty of the accused. However, taking into consideration of the request of the learned counsel for the petitioner, the matter is ordered to be listed on 20.02.2023 and there shall be an order of interim stay till then.
