O R D E R

The petitioner, who was arrested and remanded to judicial custody on 03.06.2025, for bail for the offence punishable under Section 191(2), 191(3), 115(2), 137(2), 103(2) and 190 of BNS, 2023 in Crime No.117 of 1/6

2025, registered on the file of the respondent police, seeks bail.

2. It is a case of murder in retaliation to an earlier case in Crime No.149 of 2017, on the file of the Brammadesam Police Station. Out of nine accused, one is a juvenile and another accused has already been granted bail. The petitioner, who is arrayed as A8, surrendered voluntarily on 01.06.2025. The counter by State indicates that the investigation is almost complete, except for the receipt of CDR and serology report. In the counter it is also apprehended that, if the petitioner is granted bail, he may abscond.

3. The learned counsel appearing for the petitioner submitted that the petitioner name does not find place in the First Information Report. Being a friend of the prime accused, he has been falsely implicated in the case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he opposed for grant of bail to the petitioner.

4. Heard both sides and perused the materials available on record. 2/6

Considering the materials placed and the counter filed by the State and also taking note of the apprehension of the learned Government Advocate (Crl.Side) that, if the petitioner is released on bail, he may abscond or tamper with the evidence or threatened the witnesses, this Court is of the view that the petitioner may be granted bail, subject to certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate Court, Cheyyar and on further conditions that:

[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[b] the petitioner shall report before the respondent police twice a day at 10.00.a.m., and 5.00 p.m., until further orders;

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
