Respondent Prayer: Transfer Civil Miscellaneous Petition filed under Section 24 of the Civil Procedure Code, to withdraw and transfer H.M.O.P. No.3798 of 2019 pending on the file of II Additional Judge, Family Court at Chennai, to the file of Family Court, Ramanathapuram.

ORDER

The respondent herein has filed a petition seeking divorce and the same is pending before the learned II Additional Judge, Family Court, Chennai. Petitioner herein/wife has approached this court, by way of transfer civil miscellaneous petition stating that she has got three years old child and that yet another female child was born 30 days back. The petitioner further stated that she has to appear before the Family Court, Chennai, which is more than 500 Kms and that she has already filed a Maintenance Claim before the learned Judicial Magistrate, Paramakudi. She further stated that if the matter is transferred to Family Court, Ramanathapuram, it would be feasible for both the parties to represent the matter.

The learned counsel appearing for the respondent would submit that, instead of Ramanathapuram where commutation is also a problem for both the parties, he suggested that the matter may be transferred to the Family Court at Madurai and the petitioner herein has no objection for the same. https://hcservices.ecourts.gov.in/hcservices/

3. In view of the same, H.M.O.P. No.3798 of 2019 pending on the file of learned II Additional Judge, Family Court at Chennai, is withdrawn and transferred to the file of Family Court, Madurai. The Family Court, Madurai, is expected to conclude the trial in the above matter, as expeditiously as possible, without adjourning the matter beyond thirty working days at any point of time.

4. With the above directions, the transfer civil miscellaneous petition is ordered. No costs. Consequently, the connected civil miscellaneous petition is closed.
