ORDER

The writ petitioner seeks a direction to the respondent herein to dispose of the appeal preferred in acknowledgment No.2357351/43 within a stipulated time fixed by this Court.

2. It is the case of the petitioner that her husband died while he was in service

on 22.04.2023. When she applied for legal heir certificate for her deceased husband, the same was rejected and subsequently, the respondent had issued legal heir certificate with her deceased husband's first wife, who has predeceased him without verifying the proper documents. Aggrieved over the same, the petitioner gave a representation on 23.05.2024 to the VAO to reissue the legal heir certificate with inclusion of her name as legal heir and the same has not been considered. Hence, the petitioner has filed writ petition before this Court and this Court, vide its order dated 11.06.2024 in W.P.No.15092 o0f 2024 dismissed with liberty. As per the order of this Court, the petitioner has filed appeal before the RDO on 10.08.2024 and the same is pending so far. Hence, the petitioner made a representation on 06.09.2024 to the respondent to dispose the appeal and the same has not been considered. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass appropriate orders on the petitioner's representation within the stipulated time as fixed by this Court.

4. The learned Government Counsel appearing for the respondents submitted that the representation will be considered and an appropriate orders will be passed within the time frame as fixed by this Court.

5. Heard the learned counsel for the petitioner as well as the learned

Government Counsel and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the respondent to consider the petitioner's representation dated 06.09.2024 and pass appropriate orders on the appeal within a period of four weeks from the date of receipt of a copy of this order.
