A.No.5048 of 2022 A.No.5048 of 2022 in C.S.No.78 of 2018 C.V.KARTHIKEYAN,J., This application has been filed seeking to condone the delay of 30 days in filing the written statement of D5, D6 and D7.
2. In the affidavit filed, it had been stated that owing to the sudden demise of the husband of the 5th defendant, the 5th defendant had sustained stroke, owing to high blood pressure and the 6th and 7th defendants who are her daughters were looking after her. After she recovered, she had approached the counsel and given necessary instructions to file the written statement and there has been a delay of 30 days.
3. In view of the reason stated, and particularly because it is only appropriate that the parties are permitted to file their respective pleadings in any adversarial litigation, and also on hearing the learned counsel for the plaintiff, the application stands allowed.
