THE HONOURABLE MS.JUSTICE R.N.MANJULA Palaniyammal ...

Petitioner vs.

1.The Superintendent of Police, Namakkal District, Namakkal.

2.The Deputy Superintendent of Police, District Crime Branch, Namakkal.

... Respondents Prayer : Criminal Original Petition has been filed under Section 482 of Cr.P.C., to direct the respondents not to harass the petitioner without any legal basis.

For Petitioner : Mr.S.Muthukrishnan For Respondents : Mr.S.Santhosh, Govt. Advocate (Crl.Side)

ORDER

This Criminal Original Petition has been filed to direct the respondents not to harass the petitioner without any legal basis.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents.

3. The learned counsel for the petitioner submitted that the petitioner is a cancer patient; in order to raise funds for her treatment, she has sold away the property belonging to her to one Raju; the purchaser did not pay the entire sale consideration; but he wants the petitioner to handover the entire possession to him; with that intention, he had given a complaint to the respondent police; on that score, the petitioner has been harassed by the respondent police.

4. The learned Government Advocate (Crl. Side) submitted that on the complaint given by the purchaser by name Raju, a current paper enquiry has been initiated in C.No.H2/2396/20259/SP-DGP/22 on 15.09.2022 and the same is pending.

5. Even as per the contention of the petitioner, she has executed the sale deed in favour of the purchaser on 18.02.2019. Since it appears to be a civil dispute between the parties and the complaint given by one Raju is also pending in C.No.H2/2396/20259/SP-DGP/22, the respondent police is directed to complete the enquiry on the same within a period of two weeks from the date of receipt of a copy of this order.

6. With the above observations, this Criminal Original Petition is disposed.
