PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to modify the condition of the Principal District Sessions Judge of Coimbatore, order made in C.M.P.No.3307 of 2019, dated 27.09.2019 "the petitioner direct to sign before the Judicial Magistrate, Valparai, daily twice i.e., daily at 10.00 a.m. and 5.00 p.m. Until further orders". The petitioner, who had been arrayed as an accused, was granted bail by the learned Principal District and Sessions Judge, Coimbatore on 27.09.2019 in Crl.M.P.No.3307 of 2019 for the offences under Sections 294(b), 307, 302 of IPC on certain conditions. Seeking to modify the same, the present petition has been filed.
2. Heard Mr.W.Camyles Gandhi, learned counsel appearing for the petitioners and Mrs.V.Saratha Devi, learned Government Advocate (Crl.Side) appearing for the respondent.
3. The learned counsel for the petitioner submitted that the petitioner will co-operate for the early disposal of the complaint and will appear before the Court below during all the https://hcservices.ecourts.gov.in/hcservices/
hearing dates, as and when required.
4. Taking into consideration the facts and circumstances of the case, this Court is of the considered view that the Court below ought not to have imposed such onerous conditions and accordingly, the condition, directing the petitioner to sign before the Judicial Magistrate, Valparai, daily twice i.e., daily at 10.00 AM, and 5.00 PM, until further orders, in the order of the Trial Court in Crl.M.P.No.3307 of 2019, dated 27.09.2019, is modified to the effect that the petitioner shall report before the respondent police daily at 10.00 AM, until further orders.
5. All other observations made in the earlier order dated 27.09.2019 in Crl.M.P.No.3307 of 2019 shall remain intact.
6. This Criminal Original Petition stands ordered accordingly.
