Respondents Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a writ of mandamus forbearing the respondents from in any manner preventing the petitioner from using the sand lawfully purchased by the petitioner and stored in the land comprised in Survey No.31/1A, Muthukalipatti Village, Rasipuram Taluk, Namakkal District and consequently, direct the respondents to return the seized sand to the petitioner.

O R D E R

1. After some arguments, the learned counsel for the petitioner, realizing that the Writ Petition is deficient in material particulars, as the names of the persons from whom the sand has been purchased, is not set out in the petition, seeks to withdraw the Writ Petition with liberty to file a fresh petition, along with the relevant documents.

1.1. Learned counsel also made an endorsement to that effect in the paper book.

2. Accordingly, the Writ Petition is dismissed as withdrawn with liberty as prayed for. No costs. Consequently, the connected miscellaneous petition is closed.
