The petition for bail for the offence punishable under Sections 126(2), 296(b), 115(2), 189(2), 109 of BNS read with 49 of BNS, 2023 , in Crime No.109 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the petitioner, along with others, brutally attacked Ashok Kumar, who later died in the hospital. Hence, the offence was altered to Sections 126(2), 296(b), 115(2), 189(2), 103(1) of BNS read with 249, 49 of BNS, 2023.

3. The learned counsel appearing for the petitioner submitted that the petitioner hails from a respectable family, has a permanent residence and one of the co-accused granted bail on 29.07.2025 and therefore, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police states that the investigation is still pending. He further submitted that A6, who was granted bail, had only a limited overt act attributed to him, whereas the investigation reveals that this petitioner is the prime accused and that the incident occurred as a retaliation to an earlier case. 2/4

5. Considering the facts and the stage of investigation, this Court is not inclined to grant bail at present. Hence, this Criminal Original Petition is dismissed.
