Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, direction to the 2nd respondent to remove the lock and seal order dated 28.06.2022 and consequently hand over the vacant possession.

ORDER

This Writ Petition has been filed for a direction, directing the second respondent to remove the lock and seal dated 28.06.2022.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner was engaged a business in the name and style of M/s.J.J.MEE Foods at Door No.13/06, Velayutha Raja Street, Mandaveli, Chennai - 600 028. Though the petitioner was initially issued a license, subsequently, it was revoked on the ground that the petitioner failed to follow the safety measures and also sanitary regulations, since the local residents of the street objected to the manufacturing of noodles by the petitioner in the said premises. The petitioner submitted an application for a fresh license and the same was

not considered. Therefore, the petitioner was constrained to file a writ petition in W.P.No.15774 of 2023 before this Court. By an order dated 07.08.2023, this Court directed the respondents to consider the application submitted by the petitioner and dispose of the same within a period of six weeks. However, the said order has not been complied with so far. Now, the petitioner decided to close down the business and utilise the premises for personal purposes. Therefore, the petitioner submitted a representation to remove the lock and seal on the premises at Door No.13/06, Velayutha Raja Street, Mandaveli, Chennai - 600 028.

In view of the above, the third respondent is directed to remove the lock and seal on the premises at Door No.13/06, Velayutha Raja Street, Mandaveli, Chennai - 600 028, to enable the petitioner to use the premises for personal purposes forthwith. It is made clear that the petitioner shall submit an affidavit to the effect that she will not carry out any business under the name and style of M/s.J.J.MEE Foods at the said premises.

5. With the above direction, this writ petition stands disposed of. No costs.
